Terms of Use

Welcome to bakasan.art ("the Site"). The Site presents the artwork and writings of Donald "Bakasan" Peterman and offers community features. By visiting the Site or creating an account, you agree to these Terms of Use. If you do not agree, please do not use the Site.

1. The Artwork and Site Content

All paintings, images, writings, and other artistic content presented on the Site are the property of the Bakasan estate and are protected by copyright law (© 1997–2026 Bakasan, all rights reserved). You may view and share links to the Site for personal, non-commercial purposes. You may not reproduce, sell, distribute, create derivative works from, or use any artwork for training machine-learning models without prior written permission. 2. Accounts

You must provide accurate information when creating an account and keep your password secure. You are responsible for activity that occurs under your account. You must be at least 13 years old to create an account. We may suspend or terminate accounts that violate these Terms.

3. Your Content

You retain ownership of the posts, replies, images, and other content you create on the Site ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as part of operating the Site. You can delete your User Content at any time, which ends this license for that content (except for copies kept briefly in backups).

You represent that you own or have the necessary rights to any content you post, and that it does not infringe the rights of others.

This is a community built around art, contemplation, and respectful conversation. You agree not to:

5. Copyright Complaints

If you believe content on the Site infringes your copyright, send a notice to the contact address below including: identification of the work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that you are authorized to act for the copyright owner.

6. Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that User Content will be preserved.

7. Limitation of Liability

To the fullest extent permitted by law, the Site's operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Site. Our total liability for any claim shall not exceed one hundred U.S. dollars ($100).

8. Indemnification

You agree to indemnify and hold harmless the Site's operators from claims arising out of your User Content or your violation of these Terms.

9. Changes to the Site and These Terms

We may modify or discontinue features of the Site at any time. We may update these Terms; the revised version will be posted on this page with an updated date, and continued use of the Site constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
